Terms of Service

Welcome to PhotoMetrics. These Terms of Service constitute a legal agreement between you and Sierra Data Labs LLC, doing business as PhotoMetrics ("we", "our", "us", or "PhotoMetrics"). By using our mobile application, you agree to these Terms of Service. Please read them carefully.

IMPORTANT: These Terms include an arbitration agreement and class action waiver in Section 17. Please review carefully.

1. Acceptance of Terms

By accessing or using PhotoMetrics, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use the app.

2. Description of Service

PhotoMetrics is a mobile application that:

• Allows you to photograph items you want to track (medical devices, receipts, meters, etc.)
• Uses artificial intelligence to extract numeric and text data from your photos
• Organizes your data into trackers with analytics and charts
• Stores your photos and data securely in the cloud

3. Account Registration and Age Requirement

To use PhotoMetrics, you must:

• Sign in using Google or Apple authentication
• Provide accurate account information
• Be at least 13 years of age
• Keep your account credentials secure

Age Requirement: PhotoMetrics is not intended for children under 13 years of age. By using this service, you represent and warrant that you are at least 13 years old. If we learn that we have collected personal information from a child under 13, we will delete that account and associated data.

You are responsible for all activity that occurs under your account.

4. Acceptable Use

You agree not to:

• Use the service for any illegal purpose
• Submit photos containing illegal content
• Attempt to access other users' data
• Interfere with or disrupt the service
• Reverse engineer or decompile the app
• Use the service to harm others

5. Your Content

You retain ownership of photos and data you add to PhotoMetrics. By using our service, you grant us a limited, non-exclusive license to:

• Store your photos in our cloud infrastructure
• Process your photos using AI to extract data
• Display your photos and data within the app

This license terminates when you delete the content or your account. We will not use your content for any purpose other than providing the service to you.

Content Responsibility: You represent and warrant that:

• You own or have the right to all content you submit
• Your content does not infringe any third party's intellectual property rights
• Your content does not contain trade secrets or confidential information of others

You agree to indemnify and hold harmless PhotoMetrics from any claims arising from your content, including but not limited to intellectual property infringement claims.

6. AI Data Extraction Disclaimer

PhotoMetrics uses artificial intelligence to extract data from photographs. This extraction is provided for informational and personal tracking purposes only.

You acknowledge and agree that:

• AI-extracted values may contain errors, omissions, or inaccuracies
• You must independently verify any extracted values before relying on them for any purpose
• You can manually edit any incorrectly extracted values within the app
• PhotoMetrics is not responsible for any decisions, actions, or outcomes based on AI-extracted data
• The AI may fail to extract data from some images due to image quality, lighting, or other factors

PhotoMetrics expressly disclaims any warranty of accuracy, completeness, or fitness for any particular purpose regarding AI-extracted data.

7. Health Information Disclaimer

IMPORTANT: PhotoMetrics is NOT a medical device and is NOT intended to diagnose, treat, cure, or prevent any disease or health condition.

If you use the app to track health-related metrics (such as blood pressure, glucose levels, weight, medications, or other health data):

• The app is for personal informational tracking only, not medical diagnosis or treatment
• Always consult qualified healthcare professionals for medical advice, diagnosis, and treatment
• Never disregard professional medical advice or delay seeking it based on information from PhotoMetrics
• Do not use PhotoMetrics for medication dosing or other critical health decisions
• Always verify AI-extracted health data against your actual device readings
• AI extraction of health data may be inaccurate and should never be relied upon for medical purposes

In case of a medical emergency, call your local emergency services immediately. Do not rely on PhotoMetrics for emergency medical information.

PhotoMetrics has not been evaluated by the FDA or any other regulatory authority. We make no claims regarding the accuracy or reliability of health-related data extraction.

8. Service Availability

We strive to maintain reliable service, but:

• The service may be temporarily unavailable for maintenance
• We may modify or discontinue features at any time
• Internet connectivity is required for photo processing

9. Pricing and In-App Purchases

PhotoMetrics is free to use with all features unlocked:

• Daily Complimentary Photos: Every user receives complimentary photos each day (currently 10). The daily limit is set by the server and may change.
• Photo Credits: If you need more photos in a day, you can purchase photo credit packs. Each credit covers one additional photo. Credits are consumable purchases that never expire.

Regarding in-app purchases:

• Purchases are processed by Apple through the App Store
• Photo credits are consumable, one-time purchases — not subscriptions
• Your purchase is tied to your Apple ID and can be restored on any device
• Refunds are handled by Apple according to their refund policy
• We reserve the right to change pricing for new purchases
• Existing credit balances will not be affected by price changes

10. Intellectual Property

The PhotoMetrics app, including its design, code, and branding, is owned by us and protected by intellectual property laws. You may not copy, modify, or distribute any part of the app without permission.

11. Termination

You may delete your account at any time from the app settings. We may suspend or terminate your account if you violate these terms. Upon termination, your data will be deleted as described in our Privacy Policy.

12. Disclaimer of Warranties

PhotoMetrics is provided "as is" without warranties of any kind. We do not guarantee that:

• The service will be error-free or uninterrupted
• AI extraction will be accurate for all photos
• The service will meet your specific requirements

13. Limitation of Liability

To the maximum extent permitted by law, PhotoMetrics shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service.

14. Changes to Terms

We may update these Terms of Service from time to time. Continued use of the app after changes constitutes acceptance of the new terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

16. Dispute Resolution and Arbitration

Please read this section carefully. It affects your legal rights.

Agreement to Arbitrate: You and PhotoMetrics agree that any dispute, claim, or controversy arising out of or relating to these Terms or the use of PhotoMetrics shall be resolved by binding arbitration, rather than in court, except that either party may seek equitable relief in court for infringement or misuse of intellectual property rights.

Arbitration Rules: The arbitration will be conducted by JAMS under its Streamlined Arbitration Rules and Procedures. The arbitration will be held in San Francisco, California, or at another mutually agreed location.

Class Action Waiver: YOU AND PHOTOMETRICS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

Opt-Out: You may opt out of this arbitration agreement by sending written notice to support@photometrics.io within 30 days of first accepting these Terms. Your notice must include your name, email address, and a clear statement that you wish to opt out of arbitration.

Small Claims Exception: Notwithstanding the above, either party may bring an individual action in small claims court.
